Nijigen no Mori Ticket Center Terms of Use

Nijigen no Mori Co., Ltd. (hereinafter referred to as “our company”) has established the “Nijigen no Mori Ticket Center Terms of Use” (hereinafter referred to as “these Terms”) as follows. Please accept these Terms before using the Nijigen no Mori Ticket Center (hereinafter referred to as “this service”) provided by our company.

Article 1: Scope of application and changes to these Terms of Use

1. Customers who use this service are deemed to have understood and accepted all of the contents of these Terms and Conditions. 2. These Terms and Conditions apply when you use the Service. 3. We may change these Terms of Use without obtaining your prior consent, and you must check these Terms of Use each time you use the Service. If you use the Service after we have changed these Terms of Use, you will be deemed to have agreed to the changes to these Terms of Use.

Article 2: Terms of Use

1. This service is only available to customers who purchase Nijigen no Mori attraction tickets (hereinafter referred to as “tickets”) via the Internet. Use for purposes other than purchasing tickets is prohibited. 2. This service is intended only for customers who operate and use computers and the Internet at their own risk and who operate and use computers with appropriate settings for Japanese display, email, etc. In the unlikely event that you are unable to use this service properly due to circumstances beyond our control, such as your equipment, network, OS, or provider, we will not be held responsible. 3. When purchasing tickets, you will be required to enter your personal information (hereinafter referred to as “Personal Information”), such as your name, address, telephone number, and email address, into the designated form. If any information is missing, garbled, or false, your purchase application will be rejected.

Article 3: Prohibited acts

1. Customers are prohibited from reselling tickets to third parties or providing them to third parties for resale, regardless of whether such resale is for profit or not. It is also prohibited to transfer tickets to third parties free of charge for profit purposes. 2. It is strictly prohibited for customers to purchase tickets with the intent to resell them to a third party or to provide them to a third party for resale. It is also prohibited to purchase tickets with the intent to transfer them free of charge to a third party for profit-making purposes. 3. If you violate paragraph 1 or 2, we will take measures to make all tickets purchased by you (regardless of whether or not the tickets have been subject to resale, etc.) ineligible for use in attractions or unusable. In such cases, no refunds will be given. 4. If you violate the provisions of paragraph 1 or the preceding paragraph 2, we will cancel your registration and prohibit you from purchasing tickets in the future. 5. When using the Service, you shall not engage in any of the following acts: (1) Any act that infringes or may infringe the copyright, trademark rights, other intellectual property rights, property rights, privacy rights, etc. of our company or any third party, including other customers. (2) Any act that is contrary to public order and morals, or any act that may be contrary to public order and morals, or any act that provides information that is contrary to public order and morals to third parties, including other customers. (3) Any act that constitutes a crime or that is likely to constitute a crime. (4) Election campaigning or similar activities, regardless of whether they are during an election period or not. (5) Sexual, religious, and political activities (6) Any commercial activity in relation to the Service without our consent. (7) Any act of falsifying personal information such as your name, address, telephone number, or email address, or any act of impersonation (8) Using or providing harmful programs such as computer viruses through or in connection with the Service. (9) Any act that violates or may violate laws and regulations. (10) Any other act that our company deems inappropriate.

Article 4: Ticket sales

1. The types and prices of tickets that you can purchase using this service will be as stated on the sales page. However, ticket types and prices may be changed without notice at our discretion. 2. The sales contract between us and you regarding tickets will be established at the time of our acceptance, subject to payment approval by the credit card company. 3. Please be sure to specify the date of arrival and start time when purchasing tickets. Please note that the date of arrival and start time cannot be changed after purchase. Please check before purchasing.

Article 5: Payment Methods

Ticket purchases must be paid for by credit card. You can use VISA, MasterCard, JCB, AMEX, and Diners Club credit cards. Virtual cards and other types of credit cards that do not actually exist cannot be used to exchange tickets or process certain transactions at Nijigen no Mori, so they cannot be used.

Article 6: Ticket Delivery

To receive your ticket, access the purchase history on the Nijigen no Mori Ticket Center website using the email address and password you registered at the time of purchase and download the ticket (QR code). If you have purchased multiple tickets, you can have them distributed by the date specified by our company. To receive your ticket, you must obtain the ticket (QR code) according to the method for obtaining the electronic data notified by our company, and enter the venue from the designated entrance location. You can print out the ticket (QR code) and use it. No refunds will be given if you forget the mobile phone that received the ticket (QR code) on the day of use, or if the ticket (QR code) is damaged due to a malfunction of your mobile phone, etc. Even if you are unable to collect your ticket (QR code) for any reason, we will not refund the ticket price, service fees set by our company, payment fees, or delivery fees.

Article 7: Refusal to sell or deliver

We will refuse to sell or hand over tickets to customers if any of the following applies to them.
  • If the customer makes a false declaration regarding matters specified by our company or fails to make a required declaration
  • When you have engaged in any behavior that causes inconvenience to other customers or third parties, or that interferes with our smooth sales.
  • If you do not complete the required procedures within the deadline provided by our company
  • If you do not follow the specified purchasing method
  • Any other act that violates these Terms and Conditions
Our company may claim compensation from the customer for any damages incurred by our company as described in the preceding paragraph.

Article 8: Ticket exchange, changes and cooling-off period

Tickets for which a ticket purchase contract has been concluded cannot be exchanged, changed, or canceled for any reason. However, this does not apply if the ticket purchase contract between us and you becomes invalid or is canceled, or if the contract is terminated by you due to our default on obligations. Please note that the cooling-off period does not apply to tickets sold through this service.

Article 9: Loss and theft

We will not reissue tickets under any circumstances (lost, stolen, damaged, etc.).

Article 10: Ticket Refunds

We are not responsible for any changes, cancellations, or suspensions of attractions. However, we will refund customers for tickets that are canceled or suspended in the manner specified by our company. If the refund period has passed, or if the ticket (QR code) is damaged, lost, or so defaced that it is difficult to read, we will not provide any refunds to customers. The refund to the customer will be the ticket price only, and we are not responsible for refunds of expenses other than the face value of the ticket (commissions, transportation costs, accommodation costs, communication costs, delivery fees, etc.) or compensation for damages. Please also note that it may take 3 to 4 weeks for the refund to be made.

Article 11: Termination and resumption of sales

Even during the ticket sales period, sales will end for each attraction once the planned number of tickets has been sold. However, sales may resume if there are additional slots available.

Article 12: Disclaimer of Liability for Tickets

1. We are not responsible for the sale of tickets not purchased directly from us. 2. If confirmation of the success or failure of a ticket application or purchase, or notification of such confirmation, is significantly delayed or impossible due to communication line congestion or an unforeseen computer system error, etc., our company shall not be liable for any damages incurred by customers or third parties as a result thereof.

Article 13: Personal Information

1. We will record your personal information for the purposes set out in the following paragraph. You also agree that we will record information such as your ticket purchase history and your use of the Service (hereinafter referred to as “Personal History”). If you do not agree to providing your personal information, you will not be able to use the Service. 2. We will use your personal information or personal history for the following purposes. If we use your personal information or personal history for purposes other than those set out in this section, we will notify you of the purpose of use and obtain your consent. (1) Notification of ticket sales and related services via email, etc., related to your application. (2) Notifications by email, such as tickets handled by our company and information about Nijigen no Mori. (3) User support regarding tickets and Nijigen no Mori (including responding to inquiries) (4) Provision of other services related to or incidental to the Service (5) Creating statistical data for our marketing activities (6) Responding to identity verification and legal inquiries required for the operation of Nijigen no Mori 3. You agree that when we use your personal information for the purposes set out in the preceding paragraph, we will disclose your personal information to third parties to whom we outsource business (hereinafter referred to as “subcontractors”) to the extent necessary for the outsourcing, and that the subcontractors will use your personal information to the extent necessary for the performance of the contracted business. In this case, we will contractually obligate the subcontractors not to disclose or leak your personal information to other third parties, and not to use your personal information for any purpose other than the performance of the contracted business. 4. When purchasing tickets by credit card, you agree that our company, which has accepted your ticket purchase application, will exchange personal information with the credit card company in order to confirm the validity of your credit card. 5. We may disclose all or part of your personal information and personal history to a third party without your consent if any of the following applies: (1) When required by law (2) When it is necessary to protect a person’s life, body, or property, and it is difficult to obtain the individual’s consent. Article 14: About the System

1. We may change or suspend the system related to this service without prior notice due to company needs. We shall not be liable for any damages suffered by customers as a result of this. 2. We shall not be liable for any problems that may arise if you stop your browser for a long period of time, close your browser, shut down your computer, or disconnect from the network while using the Service. 3. This service connects to some sites and servers other than ours. 4. This service uses JavaScript, SSL and Cookies.

Article 15: Attractions and shows within Nijigen no Mori

Attractions, shows, merchandise stores, restaurants, etc. on the day of admission may be changed or canceled without notice for our own convenience. Even in such cases, tickets will not be refunded unless the attraction is canceled or suspended.

Article 16: Disclaimer

Except as otherwise provided in these Terms and Conditions, we shall not be liable for any damages suffered by customers or third parties arising from the provision of various information on this service or other matters related to this service, in excess of the greater of the face value of the ticket and various fees, or 1,000 yen. However, this does not apply if such damages are caused by our intentional or gross negligence. Furthermore, use of this service is entirely at the customer’s own risk. Use of this service by minors is only possible with the consent and responsibility of their legal guardian, such as a parent. We will encrypt and otherwise manage the personal information you enter and send when using this service, and take every care to maintain confidentiality, but we cannot guarantee that information will be completely protected from leakage, loss, or tampering by third parties. We do not guarantee the safety, accuracy, reliability, usefulness, currency, suitability for purpose, legality, morality, etc. of the content of this service, the information and services provided by this service, or the information you obtain through this service or emails sent by us. We have no knowledge of, and assume no responsibility for, the information, services, etc. contained on any site linked to from this service. We do not guarantee that the number of tickets sold through this service will meet all of your purchase requests, nor do we guarantee that the details written on tickets sold through this service are true (including that the event will be held as described). We will not be held responsible for this service, except that we will contact you using the contact information you registered at the time of purchase or deliver the product to the address you specified at the time of purchase. We shall not be liable for any damages suffered by third parties due to your actions.

Article 17: Jurisdiction

In the unlikely event that a dispute arises between us and you regarding this service, the Tokyo Summary Court or the Tokyo District Court shall be the exclusive court of first instance, depending on the amount of the claim.
